SEC. 10. Whereas, an emergency exists, therefore, this act shall take effect and be in force from and after its passage.

CHAPTER 140.

Appropriation of $3989.80.

Emergency clause.

AN ACT to appropriate to Charles A. Johnson the sum of three thousand nine hundred and eighty-nine dollars and eighty cents ($3,989.80).

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. There is hereby appropriated to Charles A. Johnson, of Burt county, in this state, out of any moneys in the state treasury, not otherwise appropriated, the sum of three thousand nine hundred and eighty-nine dollars and eighty cents (3,986.80), on account of losses sustained by him in the destruction of and damage to his property in said county by fire in March, A.D. 1886, in the attempt of officers and citizens to apprehend an alleged murderer, who had taken refuge in the barn of said Johnson.

SEC. 2. There being an emergency therefor this act shall take effect and be in force from and after its passage.

CHAPTER 141.

AN ACT to compensate Robert W. Furnas for services rendered the state of Nebraska at the New Orleans centennial exposition.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That there be and hereby is appro- Appropri priated out of the general fund of the state treasury from funds not otherwise appropriated, the sum of five thousand (5,000) dollars to be paid Robert W. Furnas for services rendered the state by him while acting in the capacity of United States commissioner for Nebraska at the late cotton centennial and industrial exposition held at New Orleans, Louisiana, during the years 1884 and 1885.

SEC. 3. That on the proper voucher the auditor is hereby authorized to issue his warrant and the treasurer to pay such sum to the said Robert W. Furnas or his order.

CHAPTER 142.

Preamble.

Appropriation.

AN ACT for the relief of Cass county.

WHEREAS, Certain school lands in Cass county were assessed for taxation and taxes levied and collected for the years 1871, 1872, 1873, 1874, 1875, 1876 and 1877; and

WHEREAS, Such school lands upon which the taxes were levied and collected for said years were not then subject to taxation; and

WHEREAS, The taxes so levied and collected for state purposes amount to the sum of $1,045.05; and WHEREAS, The county of Cass, by its treasurers, has paid the said sum of $1,045.05 into the treasury of the state; and

WHEREAS, The county commissioners of Cass county have refunded the said taxes so wrongfully levied and collected for said years, to the parties paying the same, and have refunded the said sum of $1,045.05 collected for state purposes; and

WHEREAS, The state of Nebraska has not refunded the said sum of $1,045.05; or any part thereof, to said Cass county, therefore,

Be it enacted by the Legislature of the State of
Nebraska:

SECTION 1. That one thousand and forty-five dollars and five cents ($1,045.05) be and the same is hereby appropriated out of the general fund in the state treasury, to pay said taxes so refunded by

Cass county, which shall be paid by warrant of the
auditor of public accounts, upon the state treasury,
as other claims are paid.

CHAPTER 143.

AN ACT for the relief of Kearney county.

Be it enacted by the Legislature of the State of
Nebraska:

SECTION 1. That there is hereby appropriated Appropriation, out of the general fund of the state of Nebraska, the Simmerman. sum of three thousand eight hundred ($3,800) dollars, to pay and reimburse Kearney county for expenses incurred and moneys expended in the trial of Matt Simmerman.

SEC. 2. The auditor of public accounts is here- How paid. by authorized to draw his warrant on the state treasurer in favor of said Kearney county for said sum of three thousand eight hundred ($3,800) dollars or so much thereof as is necessary to reimburse said Kearney county.

CHAPTER 144.

Preamble.

Amount shall be certified by county commissioners.

Warrant authorized.

AN ACT to refund to Dixon county, Nebraska, the amount of state tax illegally collected and paid into the state treasury, and afterwards refunded by said Dixon county to taxpayers therein.

WHEREAS, Dixon county has paid into the state treasury the sum of four hundred and twenty dollars and seven cents ($420.07), which amount said county has been compelled to refund to taxpayers of said county for the reason that said taxes has been erroneously assessed and paid twice to the state. Therefore,

Be it enacted by the Legislature of the State of
Nebraska:

SECTION 1. That the county commissioners of Dixon county, Nebraska, shall certify to the auditor of public accounts the amount of state taxes so refunded to taxpayers, which have been illegally assessed and erroneously paid by said Dixon county into the state treasury, giving name of each taxpayer to whom taxes had been refunded, the date when so refunded, and the grounds upon which said taxes were refunded by said county treasurer upon order of the board of county commissioners.

SEC. 2. It shall be the duty of the auditor of public accounts upon the recepit of such certificate, to issue his warrant upon the general fund of the state, in favor of county treasurer of Dixon county for the amount so certified, and certify to the county clerk of said county the date and amount of the
