CHAPTER 137.

AN ACT for the relief of Ezra Leonard Smith.

Smith.

WHEREAS, Leonard H. Smith, of Fort Calhoun, Estate of in the county of Washington and state of Nebraska, in the year A.D. 1881, died intestate leaving real and personal estate which escheated to the state of Nebraska, and there has been paid in cash into the treasury of the state the sum of seven thousand one hundred and seventy-two dollars and eighty-three cents from said estate, and certain evidences of indebtedness and certain real estate at said Fort Calhoun, the former property of said estate, have by virtue of said escheat become the property of the state of Nebraska, and

WHEREAS, One Ezra Leonard Smith, of Hood Claimant. River, in the county of Wasco, and state of Oregon, now makes claim as nephew and only surviving heir of said estate to all the assets of the said estate, therefore

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the sum of seven thousand Appropriation. one hundred and seventy-two dollars and eighty

money in the treasury not otherwise appropriated, to pay said Ezra Leonard Smith, and the auditor is hereby authorized and instructed to draw his warrant for said amount.

SEC. 2. All real estate, evidences of indebtedness and demands of whatsoever nature the property of the escheated estate of Leonard H. Smith, are hereby assigned and transferred to Ezra Leonard Smith, heir-at-law of said Leonard H. Smith, and said Ezra Leonard Smith is authorized and empowered to collect, recover and enjoy the same as fully and in the same manner as he might have done had said estate never escheated to the state of Nebraska.

SEC. 3. An emergency existing, this act shall take effect from and after its passage.

CHAPTER 138.

Appropriation.

AN ACT for the relief of Otoe county.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That there is hereby appropriated out of the general fund of the state of Nebraska the sum of five thousand dollars ($5,000) to pay and reimburse Otoe county for the expenses incurred and the moneys expended in the trial of Quin Bohanan.

SEC. 2. The auditor of public accounts is here- Warrant by authorized to draw his warrant on the state treasurer in favor of said Otoe county for said sum of three thousand six hundred and twenty-five and seventy-five one-hundredths dollars ($3,625.75).

CHAPTER 139.

AN ACT to pay Patrick O. Hawes for collecting the claims of the state of Nebraska from the United States government.

WHEREAS, Patrick O. Hawes, the agent of the Preamble. state of Nebraska, has collected and paid into the treasury from the United States the sum of eighteen thousand and eighty-one dollars, and twentythree cents, for and on account of suppressing Indian hostilities; therefore

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the sum of four thousand Appropriation. five hundred and twenty dollars and thirty cents is hereby appropriated out of any moneys in the treasury not otherwise appropriated, to pay Patrick O. Hawes his fees for collecting said claims.
