SEC. 3. The auditor of public accounts is hereby authorized, upon the presentation of the proper vouchers, approved by the secretary of state in the manner prescribed by law, to draw his warrant on the stated funds and against the appropriation as made in this act, for the amount due such warrant, giving the name of the person and the nature of the service performed; such warrants to be drawn on the general fund, except as otherwise stated.

SEC. 4. There being an emergency for the taking effect of this act, the same shall be in force from and after its passage.

AN ACT to provide for the erection of a building for the University of Nebraska, for the practical and scientific instruction of the industrial classes and for instruction in the mechanic arts, and to appropriate money for that purpose, and to authorize the board of regents of the university to erect said building.

SEC. 2. SEC. 3. The said board of regents shall make such orders and regulations as to them may seem best respecting the procuring of bids, advertising for the same, and the making and executing of the contract for the erection of said building; they shall also provide for the giving of proper security by bidders, and upon the awarding of the contract they shall require the successful bidder to execute a good and sufficient bond to the state of Nebraska in the penal sum not less than the contract price of said building, to be approved by the president of said board, conditioned for the faithful performance of the contract awarded to him in all respects, the erection of said building according to plans and specifications, and the execution of such orders in that behalf as may be made by said board. building, whose duty it shall be to see that the plans and specifications for the erection of said building are faithfully carried out by the contractor. It shall also be the duty of said superintendent to see that all of the materials used in the construction of said building are of the best quality, and that all work is done in the best and most workmanlike manner, and that the whole conforms to the plans and specifications. It shall also be the duty of said superintendent to make and return to said board of regents or its proper fiscal officer or committee, monthly statements in writing of the progress of

Upon the approval of the estimates of said superintendent the Contractor, board of regents shall issue to the contractor entitled thereto their certificate as hereinbefore provided, for eighty per cent of the amount of such estimate, and upon such certificate the auditor is directed to issue his warrant upon the university fund for the amount of the same; when said building is fully completed to the satisfaction of said board, a final estimate shall be made and the balance remaining due under the contract shall be paid in the manner aforesaid;

SEC. 4. In the event that the party to whom
the contract for the erection of said building may
be awarded, shall fail for the space of fifteen days
after such award to give the bond required by sec-
tion 3 of this act, the said board of regents shall
proceed to cancel the said award and shall also pro-
ceed to re-let the contract, and the defaulting party
shall be liable to the state for all damages sustained
by reason of such default or the re-letting of said
contract.
The said board of regents are hereby
fully authorized and empowered to make all need-
ful orders and regulations, and to perform all acts
necessary to carry into effect the provisions of this

act.

SEC. 5. It shall be the duty of the treasurer to pay such warrants as are issued under the provisions of this act, when presented, whenever there are sufficient funds in his hands belonging to the university fund.
