A reasonable penalty will be established by the directors to be assessed for each failure to pay such periodic installments. Notwithstanding any inconsistent provision of law, the comptroller is hereby authorized and directed to receive and deposit to the credit of the provider housing loan fund revenues which, pursuant to the above established procedures, are received for repayments.

§ 2. The several amounts named herein, or so much thereof as shall be sufficient to accomplish the purpose designated, being the the unexpended balances the prior year's appropriations, are hereby reappropriated from the same funds and made available for the same purposes as the prior year's appropriations, unless herein amended, for the fiscal year beginning April 1, 1992. Some reappropriations in this section have been increased or decreased to more properly reflect legislative priorities. Certain reappropriations in this section are shown using abbreviated text, with leader dots ... used to indicate where exisiting law that is being continued is not shown. However, unless a change is clearly indicated by the use of brackets [ ] for deletions and italics for additions, the purposes, amounts, funding source and all other aspects pertinent to each item of appropriation shall be as last appropriated.

For the purpose of complying with the state finance law, the year, chapter and section of the last act reappropriating a former original appropriation or any part thereof was, unless otherwise indicated, either chapter 53, section 2, of the laws of 1991 or chapter 407, section 5, of the laws of 1991 whichever of such chapters constituted the last act reappropriating such former original appropriation.

Wherever in this budget act an amount is provided for in an item of reappropriation in excess of the amount that would actually be available for the purposes of such reappropriation by reason of the application of section 11 of chapter 407 of the laws of 1991, as added by chapter 408 of the laws of 1991, then the amount of such item of reappropriation shall be reduced to a lesser amount as calculated in accordance with the

provisions of such section. The provisions of the preceding sentence shall not be construed as a modification to, or limitation upon, the application of the provisions of subdivision 6 of such section 11.
