Foreigners, not to hold Land. and punish all fuch Perfons as fhall be guilty of the Violation of any SafeConduct or Paffport granted under the Authority of the Congress of the United States of America, or under the Authority of this State, to the Sub jects of any foreign Power in Time of War. And alfo against all fuch Perfons as fhall be guilty of the Commiffion of any Acts of Hoftility against the Subjects of any Prince or Power in Amity, League, or Truce with the United States of America, or fuch as are within this State under a general implied Safe-Conduct. 83 Violaters of fafe-guard, punished. &c. to be Acts of hof tility, &c. And also against all fuch as fhall be guilty of any Violation or Infraction of the Immunities of Ambaffadors, or other public Minifters, authorized Ambassaand received as fuch by the United States in Congrefs affembled, or of any dors, &c. Violence offered to the Perfons of fuch Ambaffadors or Minifters, their Houses, Carriages or Property, under the Limitation allowed by the Laws and Ufages of Nations, or that fhall any Ways moleft or disturb them in the free Exercise of their Religion. And be it further enacted by the Authority aforefaid, "That no Writ or Pro. cefs fhall at any Time iffue, or be maintained against any fuch Ambaffador or public Minister, authorized and received as aforesaid, or against his Goods or Chattels, or against his domeftic Servant, whereby his Perfon may be arrested, in any Civil Action. And be it further enacted by the Authority aforefaid, That the faid Courts respectively be, and they are hereby authorized and impowered to hear, try and determine, by a Jury or otherwife (according to Law) any of the Matters aforesaid, or any other Infractions or Violations of, or Offences against the known, received and established Laws of civilized Nations, agreeable to the Laws of this State, or the Laws of Nations. No writ, &c. maintainable against Ambaffadors, &c. Courts impowered to try, &c. And be it further enacted by the Authority aforefaid, That if any Injury shall be offered and done by any Perfon or Perfons whatsoever, to any fo- Injuryagainft reign Power, or to the Subjects thereof, either in their Perfons or Property, foreign powby Means whereof any Damage fhall or may in any Wife arife, happen or be redreffed. accrue, either to any fuch foreign Power, to the faid United States, to this State, or to any particular Perfon; the Perfon or Perfons offering or doing any fuch Injury, fhall be liable to pay and anfwer all fuch Damages as fhall be occafioned thereby. An Act to prevent Foreigners or Aliens purchafing, or holding Lands in this State. BE E it enacted by the Governor, Council, and Representatives, in General Court affembled, and by the Authority of the fame, That no Person who is not a Citizen or Inhabitant of this State, or one of the United States of America, shall be capable of purchafing or holding any Lands within this State, without fpecial Licence from the General Affembly. No alien may purchase without fpe lands, &c. cial licence. Provided, That nothing in this Act fhall be conftrued to work a Forfeiture of any Lands belonging to any Subject of the King of Great-Britain before the late War, or to prevent the Proprietor of fuch Lands from fel- Provifo. ling and difpofing of the fame to any Inhabitant of any of the United States: Nor to hinder the Subjects of the King of France from enjoying the Privileges and Benefits to which they are entitled by Virtue of the Treaty of Amity, made and ratified by and between His Most Christian Majesty, and the United States of America. 84 Forgery. Forms of Writs, &c. Be An Act against Forgery. E it enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the fame, That if any Perfon or Perfons fhall willingly and falfely forge and make, or caufe to be forged or made, or shall aid, abet, help or affift in the falfely forging and making any false Deed, Conveyance, Will, Teftament, Bond, Bill, Receipt, Releafe, Acquittance, Letter of Attorney, or any other Writing to prevent Equity and Juftice; fuch Perfon or Perfons being thereof duly convicted, fhall stand in the Pillory three feveral Lecture Days, or other Days of public Meeting; and render and pay to the Party or Parties injured thereby, double Damages, to be recovered by Action founded on this Statute; and fhall also be rendered incapable, and be difenabled to give any Evidence or Verdict in any Court, or before any Magistrate or Juftice of the Peace. E it enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the fame, That if any Man shall commit Fornication with any fingle Woman, upon due Conviction thereof, each of them fhall pay a Fine of Thirty-Three Shillings to the Treafury of Fine 335. the County in which fuch Conviction is; or be corporally punished by whipping, not exceeding Ten Stripes each; at the Discretion of the County Court who fhall have Cognizance of faid Offence. An Act for Prevention of Frauds and Perjuries. E it enacted by the Governor, Council, and Reprefentatives, in General Court or Baffembled, and by the Authority of the fame, That no Suit in Law Equity fhall be brought or maintained upon any Contract or Agreement that shall be made after the firft Day of December, One Thousand Seven Hundred and Seventy-One, whereby to charge any Executor or Adminiftrator, upon any special Promife, to answer Damages out of his own Eftate; or whereby to charge the Defendant upon any special Promife to anfwer for the Debt, Default, or Miscarriages of another Perfon; or to charge any Perfon upon any Agreement made upon Confideration of Marriage; or upon any Contract, or Sale of Lands, Tenements, or Hereditaments, or any Intereft in or concerning them; or upon any Agreement that is not to be performed within the Space of one Year from the making thereof; unless the Agreement upon which fuch Action fhall be brought, or fome Memorandum or Note thereof fhall be made in Writing, and figned by the Party to be charged therewith, or fome other Perfon thereunto by him lawfully authorized. And be it further enacted by the Authority aforefaid, That no Suit in Law or Equity fhall be brought or maintained upon any Contract or Agreement that hall hereafter be made, and not reduced to writing as aforefaid, but within three Years next after entering into, or making the fame, or on any fuch Contract or Agreement heretofore made, but within three Years next after a Right of Action thereon fhall accrue; or if fuch Right of Action hath already accrued, fuch Suit fhall not be brought, but within three Years next after the first Day of June, One Thousand Seven Hundred and Seventy-One.
