SEC. 1. [As amended June 29, 1906, April 13, 1908, 41 Stat. L. 474. June 18, 1910, May 29, 1917, August 10, 1917, February

(1)2 That the provisions of this part shall apply to Act applies to common carriers engaged in—
common carriers engaged in
(a) The transportation of passengers or property transportation wholly by railroad, or partly by railroad and partly by railroad and water when both are used under a common control, management, or arrangement for a continuous carriage or shipment; or
(b) The transportation of oil or other commodity, -transportation except water and except natural or artificial gas, by pipe line, or partly by pipe line and partly by railroad or by water;
1" Part I" inserted by amendatory act of Aug. 9, 1935 (49 Stat. L. 543), which provided: "That the Interstate Commerce Act, as amended, herein referred to as 'Part I', is hereby amended by inserting at the beginning thereof the caption 'part I', and by substituting for the words 'this act', wherever they occur, the words this part', but such part I may continue to be cited as the 'Interstate Commerce Act', and said Interstate Commerce Act is hereby further amended by adding the following part II:" [followed by the Motor Carrier Act, 1935].
The catch-line sub-titles preceding sections in Part I are not in the original act, but are those employed in the United States Code: the sub-titles in part II are those appearing in the Act of August 9, 1935.

The act does not apply to Puerto Rico: act of Mar. 2, 1917 (39 Stat. L. 964), and amendatory act of Mar. 4, 1927 (44 Stat. L 1418), U. S. Code, title 48, sec. 751.
