MAY 28, 1891.

The Board met at the Chamber of Commerce, New York city. All present.

The Board heard J. C. Wilbur, of Stony Ford, N. Y., complainant, against the New York, Ontario and Western and West Shore railroads, as to transportation of his milk from Stony Ford to Cranstons. Mr. Wilbur appeared for himself, John B Kerr for the New York, Ontario and Western Railroad Company, and Ashbel Green, counsel, J. D. Layng, general manager, and Percy Todd, general freight agent, for the West Shore road.

The hearing was concluded and adjourned.

The Board heard T. F. C. Demarest, as to increase of stock of Manhattan Elevated Railway Company ($4,000,000) to exchange for like amount of stock of the Suburban Rapid Transit Company. C. E. Tracy also appeared.

Ordered hearing set down in matter of ventilating and lighting Fourth avenue tunnel, Chamber of Commerce, New York city, Wednesday, June 3d, 10 A. M.

On May 29, the Board inspected plans of signal apparatus used by New York Central and Hudson River Railroad Company and New York, New Haven and Hartford Railroad Company.

Commissioner Rogers submitted a report in the matter of the application of the Manhattan Elevated Railway Company, for an increase of capital stock to $1,000,000 with which to absorb the Suburban Elevated railroad, granting the same. Adopted and ordered issued, with the certilleate as to the same.

Also a report in the matter of an application of the New York Central and Hudson River Railroad Company for an investigation and report by the Board upon the Westinghouse automatic pneumatic system of block signaling. Adopted and ordered issued. The Board heard Mr. C. M. Balen in the matter of the Ithaca, Auburn and Western Railroad Company. Adjournment of hearing in same asked for and granted until July 7th, 10 A. M.

Commissioner Rickard submitted a report in the matter of accident on the Montauk division of the Long Island railroad at Parkville, May 15th, 1891. Adopted and ordered issued.

The inspector submitted his report in the matter of the examination of the Poughkeepsie bridge upon his report and of the bridge engineer. Ordered that reports be transmitted to the president of bridge company with letter as dictated, copy of which is on file, and hearing be set down for same at the Brevoort House, New York city, at 10 A. M., Thursday, June 4th, 1891.

Ordered that the plan for a foot bridge over tracks at East Albany be approved. Letter of J. N. Sanborn, superintendent, The United Gas Lamp Company, asking date of hearing on tunnel lighting and ventilating. Ordered that he be informed that it will take place at the Chamber of Commerce, June 3d, 1891, 10 A M., but that the Board has no actual measurements at hand such as are required.

The Board met pursuant to adjournment. A hearing was given on the report of the inspector and bridge, engineer of the Board, as to the Poughkeepsie bridge. John L Wilson, president, P. P. Dickinson, engineer, and Charles A. Morgan, counsel, appeared for the Bridge company. Charles Macdonald and H. Steward. also appeared for the Bridge company. Order of the Board was made as shown by copy on file.

Ordered Secretary answer that the Board decrees that the greater includes the less, and that if the increase is approved by two-thirds of all the shares of stock, the company would come within the requirements of the law, which is sections 44, 45, 46, of chapter 564, Laws of 1890. Ordered that Secretary write: "In response to your request, Commissioner Rogers will be at the Grand Central depot, New York. New Haven and Hartford office at 9 o'clock, Wednesday, 10th inst. Please acknowledge this letter, upon its receipt, to Commissioner Rogers at the Union League Club, at Fifty-ninth street and Fifth avenue."

A hearing was given on the complaint of citizens of Binghamton against the Delaware and Hudson, New York, Lake Erie and Western, and Delaware, Lackawanna and Western Railroad Companies, as to dangerous condition of Chenango street crossing. John D. Wales, Senator O'Connor, and a large number of other citizens and representatives from the railroads complained of, appeared.

The Board adjourned.

JUNE 11, 1891.

The Board met at the Chamber of Commerce, city of New York. All present. The Board heard Mr. Dykman, of Bergen & Dykman, counsel for the Coney Island and Brooklyn Railroad Company in the matter of the application of that road for approval of a change of motive power on a portion of its route. Assistant Corporation Counsel of Brooklyn, A. C. Salmon, opposed the application, also Park Commissioners Brower and Lubcom. The hearing was adjourned to a date when argument on legal questions in the case shall be submitted to the Board.

A hearing in the application of the Atlantic Avenue Railroad Company's application for approval of a change of motive power was set down for June 18th, at Chamber of Commerce.

The Board adjourned until Monday, June 15, at 1 P. M.

JUNE 15, 1891.

The Board met pursuant to adjournment. All present.
The minutes of the last meetings were read and approved.

Mr. John Adams, general superintendent, and Mr. Cheever, engineer Fitchburg Railroad Company, were heard in the matter of an interlocking switch and signal apparatus at Lebanon Springs crossing. Ordered that letter as dictated, copy of which is on file, be sent to Mr. Bennett, superintendent Lebanon Springs road.

The Secretary submitted the accumulated business under the rule, as follows: Letter of M. S. Blair, Lackawanna and Pittsburgh Railroad Company, relative to complaint of Mr. Fairbanks. Ordered usual course.

Letter of William Richardson, relative to reported comment of ex-Park Commissioner Kennedy, of Brooklyn, on utterance of Mr. Boardman, counsel for applicant. Ordered that with the statements made the Board prefers to have the matter dropped. Letter of E. A. Gallup, Automatic Car Coupler Company. Ordered flled.

Board met at office of New York Central and Hudson River Railroad Company Forty-second street, New York city, pursuant to adjournment. All present.

C. M. Depew, president; Charles C. Clarke, vice-president; J. M. Toucey, general manager; Theodore Voorhees, general superintendent; Walter Katte, chief engineer. and others, present on behalf of railroad company.

The Board recommended a plan and submitted drawings to illustrate the same for ventilating the tunnel. The proposed method was accepted by the company and orders were issued by Mr. Depew to have an experimental section thereof immediately constructed in the side tunnel between Fifty-sixth street and Sixty-seventh street, Board adjourned to 12 o'clock noon, Thursday, June 18, 1891, at rooms of Chamber of Commerce, New York city.

JUNE 18, 1891.

Board met at Chamber of Commerce, New York city, 12 o'clock noon, pursuant to adjournment. All present.

Wm. Richardson and Mr. Boardman appeared for the Atlantic Avenue Railroad Company of Brooklyn: Sidney V. Lowell, appeared on behalf of abutting property owners on Ninth Avenue, Brooklyn, in the matter of the application of the said railroad company for the approval of the Board of change of motive power.

Board adjourned to its rooms at Albany on Monday, June 22, 1891. at 1.30 P. M.

The Board met at 1.30 P. M., pursuant to adjournment. All present.
Minutes of the last meeting were read and approved.

The acting Secretary submitted the accumulated business, under the rule, as follows: Letter of E. D. Bennett, superintendent of Lebanon Springs Railroad Company, relative to interlocking signal and switch apparatus at Pittsburg Junction, same placed on file and decision of Board, in the matter, dictated and ordered sent to John Adams, general superintendent Fitchburg railroad, and E. D. Bennett, general superintendent, Lebanon Springs Railroad Company.

Letter of J. C. Wilbur, in matter of West Shore Railroad Company and New York, Ontario and Western Railway Company. Ordered that order to show cause before Board at 2 o'clock, P. M., of Monday, June 29, 1891, at Albany, why failure to conform to recommendations of the Board made June 4, 1891, in said matter should not be reported to the Attorney-General for such action as is provided for under section 162, chapter 565, Laws of 1890, be sent by registered letter to president of New York, Ontario and Western Railway Company and that Mr. Wilbur be notified by mail of the action of of the Board.

Reply of the complainants in re Residents of Angelica v. Lackawanna and Pittsburg Railroad Company referred to Commissioner Rickard to visit locality and report to Board; also ordered that Secretary notify the complainants and the railroad company that Commissioner will at an early day in the future advise them as to date he will be at Angelica to make the examination.

Communication from Edward J. Mitchell, coroner of Westchester county, accompanied by findings of the coroner's jury in the matter of the accident at or near Tarrytown of May 19th, 1891; also communication from J. M. Toucey, general manager New York Central and Hudson River Railroad Company. Ordered filed with the papers in office of Board relating to such accident, subject to such further action, if any, in the premises as the Board may hereafter determine upon.

In the matter of the application of Syracuse, Eastwood Heights and De Witt Railroad Company for increase of its capital stock. Proof of publication of notice and certified copies of proceedings of meeting of stockholders submitted, and ordered that letter as dictated be sent to Geo. B. Warner of Syracuse, attorney for company, inclosing certifled copies of proceedings of meeting of stockholders for necessary corrections and amendments.

Complaint of Geo. O. Membery against the New York Central and Hudson River Railroad Company (Rome, Watertown and Ogdensburg division). Ordered usual course. Complaint of Barent W. Stryker against the New York Central and Hudson River and Fort Orange Railroad Companies for failure to file map of road as required by statute.
