The Board considered the answer of the New York, Lake Erie and Western Railroad Company to complaint of W. J. Cunningham.

The Harlem Bridge, Morrisania and Fordham Railroad Company filled consents of Boston Avenue Railroad Company, making majority of the same. Ordered filled. The Board approved the bill of Jas. B. Lyon, for printing 500 reports, at $2,489.75. The Board adjourned to meet in Brooklyn, at 10 A. M., April 22d.

APRIL 22, 1891.

The Board met pursuant to adjournment in city of Brooklyn. All present. Hearing was had on the application of the Coney Island and Brooklyn Street Railroad Company, for change of motive power from horses to electricity. Order was made by the Board, as per copy filed with papers in this case.

The Board gave a hearing on the application of the Atlantic Avenue Railroad Company of Brooklyn, for change of motive power from horses to electricity on a portion of its route. The company also submitted an application for change to electricity on an additional portion of its route. Order of the Board was made as shown by copy filled with the papers in this case.

The Board heard the application of the Atlantic Avenue Railroad Company of Brooklyn for increase of capital stock.

Adjourned until Monday April 27th, 2 P. M. at Albany.

The Board met pursuant to adjournment.

Present-Commissioners Baker and Rickard. Commissioner Baker in the chair. The Secretary submitted that Commissioner Rogers was in attendance upon a meeting of the committee of the convention of the Railway Commissioners of the various States of the Union and of the Interstate Commissioners on Railway Appliances of which he is a member, at Washington, D. C. Ordered entered upon the minutes.

The minutes were read and approved.

The Secretary submitted the accumulated business under the rule, as follows: Letter of William Richardson and certificate of the meeting of the stockholders of the Atlantic Avenue Railroad Company, as to increase of capital stock. Ordered filled. Letter relative to application of the New York and Long Island Railroad Company for an increase of capital stock. Ordered that letter as dictated, copy of which is on file. be sent.

Letter of Ray Hubbell, relative to his complaint against the Fonda, Johnstown and Gloversville Railroad Company. Ordered that the papers in the case be referred to Commissioner Baker for report.

Letters of H. M. Watson, and Messrs. Box, Norton & Bushwell, relative to application of the Buffalo Railway Company for a change of motive power. Ordered filed. Report of the inspector, relative to the condition of the Sea View Elevated railroad, as transmitted to the Board by its chairman. The Board met pursuant to adjournment. All present.
The minutes of the last meeting were read and approved.

The Board took up for consideration Assembly bills 492 and 607, and Senate bills 269, 181 and 610, which were referred to the Board by the governor for report. Ordered that the same be returned with the respective reports thereon.

The Board heard Marcus T. Hun, J. H. McClement and T. D. Morscrop in support of, and J. D. Stover and Mr. Reynolds, city attorney of Amsterdam, in opposition to the application of the Amsterdam Street Railway Company, for permission to change its motive power, Postponed to May 11th, 2 P. M.

The Board also heard John A. De Remer and Mr. Gilmore, secretary, in favor of the application of the Schenectady Railway Company for change of motive power. No opposition being made thereto. Ordered that decision granting same be issued. The Secretary submitted the accumulated business under the rule, as follows: Letter of Arthur C. Salmon, assistant corporation counsel of Brooklyn, with brief, affidavits and maps relative to the application of the Coney Island and Brooklyn Railroad Company for permission to change its motive power on a portion of its route. Ordered filed.

Application of the Genesee and Wyoming Valley Railroad Company for designation of paper in which to publish notice of meeting of stockholders, called to consider the proposition to issue bonds. Ordered paper designated.

Ordered that Secretary write that the law which goes into effect May 1st, 1841, that is to say, chapters 563, 564 and 565, Laws of 1830. does not seem to provide for an individual, building, maintaining and operating a railroad. Ordered that letter as dictated, copy of which is on file, be sent to the Pullman Palace Car Company. The Board took a recess to Tuesday, May 5th, 10 A. M.

The Board heard Porter Norton and Mr. Lang, corporation counsel of Buffalo, et al, in the matter of the application of the Buffalo Railway Company to change its motive power on Main street. Order decision granting the same be issued.

Also Mr. Fenner in support of application of Dunkirk and Fredonia Railroad Company for a change of motive power. Ordered that decision granting same be issued.

Letter of Hon. Edward Wemple, announcing that he had acceded to request of the Board to submit the construction of the item relating to Board in the annual appropriation bill of 1890, to the law officer of the State.

Letter of E. W. Cummings, asking extension of five days for complainant to reply to answer of road, in the matter of the Underwood crossing.

Letter of Hon. J. A. Cantor asking a hearing before Board. Ordered that Secretary telegraph that hearing is set down for 6th instant, at 10 A. M., in city of Brooklyn. Board adjourned to meet at City Hall, city of Brooklyn, on 6th inst., at 10 A. M.

The Board met in city of Brooklyn pursuant to adjournment. All present.

A hearing was had on the application of the Atlantic Avenue Railroad Company of Brooklyn, for permission to change its motive power on certain portions of its lines. The Board heard William Richardson, president of road, in favor of the application, and S. V. Lowell and other property owners against the application. Order of the Board was made, as appears from copy filed with papers in the case. Board adjourned to meet in city of Albany, May 11th, 1891.

The Board met pursuant to adjournment. All present.
The minutes of the last meeting were read and approved.

The Board heard J. H. McClement, T. D. Morscrop and Mr. Hodgson in favor of, and M. H. Stover and Mr. Reynolds, city attorney of Amsterdam, in opposition to the application of the Amsterdam Street Railway Company, asking permission to change its motive power. Hearing closed and briefs ordered filed.

The Board also heard Mr. H. L. Sprague in favor of the application of the Herkimer. Newport and Poland Railroad Company, for permission to change its gauge from the narrow to the standari gauge. Ordered approved, conditioned upon receiving proof of the publication of notice of hearing in Herkimer.

The Secretary submitte i the accumulated business under the rule, as follows:

Letter of J R. Shephard, relative to checking baggage on Long Island railroad. Ordered copy sent to the company.

Letter of manager of Delaware and Hudson Canal Company, relative to same. Ordered that Secretary inform the Delaware and Hudson Canal Company that answer should be filled with Board by Thursday, May 14th, 1891.

Letter of Rusk & Boland, relative to master mechanics' meeting as to car couple re Ordered that Secretary write Board knows of no meeting of master mechanics. Petition of residents of Batavia as to connecting switch between the New York Central and Hudson River railroad and the New York, Lake Erie and Western railroad. Ordered usual course.

Application of New York and Long Island Railroad Company, for an increase of capital stock. Ordered that Secretary write to the effect that it says that a certified copy of a resolution adopted by the stockholders of the company giving sanction to the increase of capital stock to $10,000,000 was inclosed. No such inclosure was found. Before acting the Board will require a properly certified copy of the proceedings of the stockholders giving the number of shares voted on. I am further instructed to ask under what authority, given in the General Railroad Law, you propose to construct this tunnel.

Affidavit of Thos. McCann, relative to Coney Island and Brooklyn Railroad Company. Ordered filled.

Petition of residents of Bullville, relative to station accommodation. Ordered usual

course.

Letter of Horace Porter, vice-president, Pullman Palace Car Company, relative to failure of a conductor to honor a State pass. Ordered kept on file.

Letter of Lansing Morse, relative to a light for lighting tunnel. Ordered Secretary write asking what the nature of the light is; if it is arc-light or incandescent. Ordered kept on file.

Letter of W. H. Williams, complaining of Albany Railway Company for insufficiency of car service between State street and Van Woert street. Ordered usual course.

Report of accountant in matter of reports from Wellsville, Coudersport and Pine Creek Railroad Company. Ordered that report be transmitted to the company saying Board approves of it.

MAY 12-10 A. M.

The Board considered communication of Ed. Lauterbach as to Twenty-eighth and Twenty-ninth Street Railway Company. Ordered Secretary write that unless the Board receives notice within two weeks that the roads have been put into operation, the Board will be obliged to summon the railroad company to show cause why the matter should not be referred to the Attorney-General for his consideration and action, with the view to taking measures for forfeiting the charter of the company.

The accountant reported that the Rome Street Railroad Company and Newburgh Street Railroad Company had made quarterly reports without a general balance sheet. and also the failure of the Elmira and Horseheads Railroad Company to file the two last quarterly reports, and received instructions on the same.

Commissioner Rogers submitted a report in the matter of the application of the Coney Island and Brooklyn Railroad Company. Ordered adopted, and laid on table to be printed.

Ordered that Secretary send subpoenas to John D. Teller in matter of complaint of Murdock & Conger against the Lehigh Valley Railroad Company and Geo. M. Diven, and write that Board has set down a hearing for May 19th, 10 A. M.

The Board met pursuant to adjournment. All present.
The minutes of the last meeting were read and approved,

Mr. Beach, representing the New York, New Haven and Hartford Railroad Company and the New York Central and Hudson River Railroad Company, appeared and was heard relative to interlocking signal device at grade crossing of the Spuyten Duyvil branch of the New York Central and Hudson River railroad and the New York, New Haven and Hartford railroad. Order was made as filed with the papers, relative to communication being sent Board by Division Superintendent Sheperd of the New York. New Haven and Hartford Railroad Company.

The secretary submitted the accumulated business under the rule, as follows:
