Commissioner Rogers submitted a report in matter of rehearing complaint of citizens of Painted Post against New York, Lake Erie and Western railroad. Adopted and ordered issued.

Commissioner Rogers submitted a report as to Troy and Lansingburgh railroad change of motive power. Adopted and ordered issued.

The Board heard A. T. Britton and Gen. Slocum, relative to change of motive power of the Coney Island and Brooklyn Railroad Company.

The Board heard Richard Tobin, relative to a system of cable propulsion for street

cars.

The Board heard Mr. Gibson, relative to improved ties and stringers for street railroad
bed.

The Secretary submitted the unfinished business under the rule, as follows:

The Board met pursuant to adjournment.

Thomas D. Mosscrop appeared, relative to change of motive power of Amsterdam Street Railroad Company.

Robert Lenox Banks appeared, relative to his complaint against the Glens Falls branch of the Delaware and Hudson Canal Company. The report of Thomas W. Spencer, inspector, showing the condition of the Glens Falls branch was read. Ordered that copy of report be sent road, also Mr. Banks. Ordered, also, that letter as dictated be sent H. G. Young, second vice-president of said road, and also a copy of such letter to Mr. Banks.

Commissioner Rogers submitted a report in matter of citizens of Westchester against the New York, New Haven and Hartford Railroad Company. Adopted and ordered issued. Commissioner Rickard submitted a report in matter of explosion of Lehigh Valley locomotive No. 261. Adopted and ordered issued.

The Secretary submitted the unfinished business under the rule, as follows: Letter of J. D. Layng, relative to accident at Genesee Junction. Ordered that Seeretary write that the accident has been investigated by a member of the Board at the scene of the accident, and that the investigation is still being continued.

Application of the Maple Avenue and Elmira and Horseheads Railway Company, for leave to change its motive power. Ordered that letter as dictated be sent, and that hearing of the same be set down for Tuesday, July 29th, 10 A M.

Letter of S. M. Felton, Jr., vice-president, New York, Lake Erie and Western Railroad Company, relative to interlocking switches. Ordered filled.

Letter of I. D. Barton, superintendent Long Island Railroad Company, relative to Hillside avenue crossing, Jamaica. Ordered that letter as dictated, copy of which is on file, be sent.

Letter of Second Avenue Railroad Company, relative to complaint now pending against said road. Ordered carried on fille.

Letters of Stowell & Corbin and C. H. Allen, president Western New York and Pennsylvania Railroad Company, relative to complaint of former against the latter. Ordered filed and case closed.

Reply of Citizens' Association of Blythbourne, to answer of Brooklyn, Bath and Coney Island Railroad Company, to complaint of former. Ordered that hearing of same be set down for Wednesday, July 30th, 12 M., at Chamber of Commerce and parties in interest be notified, and the complainants to produce a well defined map of the sections involved.

Letter of R. L. Banks, relative to accident on the Glens Falls branch of the Delaware and Hudson Canal Company's road. Ordered that letter to H. G. Young, as dictated, be sent, and also copy of same mailed to Mr. Banks.

Letter of W. W. N. Smith, relative to the Blythbourne complaint. Ordered Secretary write that Board will bring the matter up at the hearing at Chamber of Commerce, July 30th, 12 M.

Complaint of Lorenzo Morris, relative to certain alleged offenses by the Lake Shore and Michigan Southern, the Western New York and Pennsylvania and the New York, Chicago and St. Louis Railroad Companies. Ordered that Secretary write that the Board does not consider complaints of a single individual with regard to a considerable number of rade crossings covering a wide territory. If he were to present a complaint signed by local authorities, or a considerable number of citizens of the vicinities, the Board would consider it.

Letter of Jonathan Head, complaining of failure of the New York and Massachusetts Railroad Company to maintain fences. Ordered usual course.

Letter of L. M. Gillet, relative to the application of the Lake Mahopac Railroad Company for an increase of capital stock to $18,000. Granted and ordered that the report submitted be approved and issued as the order of the Board.

Letters from New York, New Haven and Hartford Railroad Company, relative to the decision in the matter of increased train service on Harlem branch. Ordered filed. Answer of the New York, Lake Erie and Western Railroad Company to complaint of Thomas Fitzgerald. Ordered copy sent to Mr. Fitzgerald.

Reply of citizens of Locust avenue to answer of Long Island Railroad Company to complaint of former of insufficient train service. Ordered copy sent to company.

Commissioner Rogers submitted a report in the matter of the application of the
Amsterdam Railroad Company to sanction a change of motive power. Adopted and

Commissioner Rogers submitted draft of a letter in the matter of the rail to be used
by the Third Avenue Railroad Company. Adopted and ordered issued.

The Board heard Mr. John I. Davenport, in the matter of the application of the
Broadway Railroad Company.

The Secretary submitted the unfinished business under the rule, as follows:
Letter of Lorenzo Morris, relative to dangerous crossings on the Lake Shore and
Michigan Southern, Western New York and Pennsylvania and New York, Chicago and
St. Louis railroads near Fredonia. Referred to Commissioner Rickard.

Letter of R. D. Weston Smith, assistant counsel New York and New England Railroad Company, relative to the order of the board of health of the town of Fishkill, prohibiting the blowing of whistles and the ringing of bells. Ordered referred to the State Board of Health, with request that it will inform the Board as to the authority possessed by the local board of health, and ordered that Secretary transmit the same when received.

Letter of McLeod Car Heating Company. Ordered filed with improvements.

Letters of B. B. Griffen and of H. G. Young, second vice-president, Delaware and Hudson Canal Company, relative to Ingersoll's crossing. Ordered that so much of the letter of Mr. Young as refers to the necessary action of the town be transmitted to Mr. Griffen, and that he be informed that the company conforms to the recommendation of the Board.

Letter of John D. Parsons, Jr., director of the Kinderhook and Hudson Railroad Company, being answer to the complaint of J. H. Stott. Ordered usual course.

Letter of Benjamin Norton, second vice-president Long Island Railroad Company, relative to the complaint of Locust Valley. Ordered carried on fille and Secretary inform complainants that the Board has adjourned for thirty days for its annual vacation, and that on reassembling it will further consider his complaint.

Letters of Delaware and Hudson Canal Company, being answer to R. L. Banks' letter alleging a speed over schedule time and announcing conformity with recommendations of Board as to the road-bed at Caldwell's branch. Ordered filed.

Answer of New York and Massachusetts Railway Company to complaint of Jonathan Head, and reply of latter to the former. Ordered that copy of Mr. Head's letter be sent company and Secretary write that Board trusts it will put the fences in satisfactory condition without necessitating Board making a personal examination.

Letter of Samuel G. French, relative to obstructions between tracks. Ordered Secretary write that there is no law on subject, and no general rule by the Board, but in certain specific instances the Board has recommended the removal of obstructions.

Letter of P. H. Foster, being reply to answer of Long Island Railroad Company to his complaint of excessive rates. Referred to Commissioner Baker.

Reply of I. P. Fowler, president New York, Ontario and Western Railroad Company, to complaint of Robert McAdam & Sons, alleging excessive switching charges. Ordered usual course.

Letter of G. O. S. Hart, president Second Avenue Railway Company of New York city. Ordered that letter as dictated, copy of which is on file, be sent.

The Board heard Mr. D. C. Robinson in the matter of the application of the Maple Grove Railroad Company of Elmira.

The Secretary submitted the unfinished business under the rule.

Letter of J. M. Toucy, relative to removal of gateman at Manlius. Ordered that copy of letter be sent to the petitioners, and case closed.

Letter of E. F. Godeffroy, being answer to aud appearance in citation, to show cause why the failure of the Kanona and Prattsburgh Railroad Company should not be presented to the Attorney-General. Ordered that copy of the letter be sent to Mr. Robie, and that the Secretary write to Mr. Robie that he specify the points where the fences have not been built.

Letter of J. V. Clarke, relative to the complaint of J. H. Stott against the Kinderhook and Hudson Railroad Company. Ordered held on file.

Commissioner Rogers submitted a report in the matter of the rail to be used by the Third Avenue Railroad Company. Approved and ordered issued.

Commissioner Rickard submitted a report in the matter of residents of towns of Schuyler and Frankfort against the New York Central and Hudson River Railroad Company. Approved and ordered issued.

Commissioner Rogers submitted a report in the matter of the application of the Brooklyn and Coney Island Railroad Company to change its motive power on Sea Breeze Avenue. Adopted and ordered issued.

Also a report in the matter of the application of the Maple Grove Railroad Company of Elmira for permission to change its motive power. Approved and ordered issued. The Board adjourned to meet in city of New York, July 30th, at 12 M., at rooms of Chamber of Commerce.

The minutes of the last meeting were read and approved.

The Secretary submitted the unfinished business under the rule, as follows: Complaint of C. B. McDonough, commissioner of highways, and F. V. Foster, overseer of highways, town of Dunkirk, as to the condition of grade crossings on the Lake Shore and Michigan Southern railroad, the Western New York and Pennsylvania, and the New York Central and St. Louis railroads, in the town of Dunkirk. Ordered usual course. Affidavit of L. H. Ackerson, as to the failure of the Kanona and Prattsburgh Railroad Company to build and maintain fences. Ordered that matter be referred to the Attorney-General with the papers.

Letter of W. Abbott, relative to rates of fare charged on the Delaware and Hudson railroad on the Albany and Susquehanna branch. Ordered, copy sent to the company. Letter of J. D. Layng, relative to Cazenovia tunnel. Ordered that Secretary write Mr. Spencer for report on the same.

Letter of John French, relative to failure of the Belt Line Railroad Company of Utica to repair road in front of his premises. Ordered that the company be cited to show cause the 9th of September, 10 A. M.

Letter of John A. Schilling, relative to the application of the Coney Island and Brooklyn Railroad Company to change its motive power within the city of Brooklyn. Ordered earried on file, and that Mr. Schilling be informed that no application has been made. Letter of R. L. Banks, relative to condition of the Glens Falls branch. Ordered that Secretary answer as instructed.

Letter of Robert Me Adam & Sons, relative to switching rates at Rome by the New York. Ontario and Western Railroad Company. Ordered copy of letter be sent to company: also ordered that draft of letter submitted relative to the accommodations and facilities afforded by the Long Island Railroad Company at Hunter's Point, be sent to the company.

Letter of W. Heagerty, of Oswego, relative to rates charged by the New York, Lake Erie and Western, and the Delaware, Lackawanna and Western Railroad Company, from New York and Philadelphia to Oswego. Ordered that the Secretary write that it seems to the Board that redress can only be obtained by making complaint to the Interstate Commerce Commission.

Letter of M. Jansen, relative to charges of freight rates by railroads. Ordered that Secretary write that his letter was laid before the Board upon its reconvening, and to say: 1. That there is no particular form necessary, and that the facts should be specifically stated; and 2. That a complaint of three years standing is not outlawed, but seems to be somewhat late.

Letter of W. S. Lyon and W. Abbott, relative to the Suburban Rapid Transit Company. Ordered that letter, copy of which is on file, be sent.

Letter of John French, relating to his complaint against the Utica Belt Line Company, announcing satisfactory settlement. Ordered filed and case closed.

Letter of Reuben E Robie, relative to the failure of the Kanona and Prattsburgh Railroad Company to build fences along its line. Ordered that Secretary write that the petition had been received, and with other petitions to the same effect, had been referred to the Attorney-General with the recommendation that he should take action under the provisions of chapter 252, Laws of 1854, and other acts pertinent thereto.

Letter of G. C. Northrup, asking for a hearing in case of the New York, Lake Erie and Western Railroad Company should apply for a suspension of the Lake Conesus branch Ordered filled.

Petition of residents of town and village of Fort Covington, praying that the United States and Canada Railroad Company should be prevented from building a pile bridge over Salmon river and thus obstructing the water-course. Ordered usual course.

Letter of B. B. Griffen, announcing that the town of Wilton, Saratoga county, would furnish the necessary land for all improvements at Ingersoll's crossing. Ordered that a copy of the letter be sent to the Delaware and Hudson Canal Company, with the suggestion that the matter be consummated as soon as possible, and that B. B. Griffen be notified.

Letter of T. P. Fowler, president New York, Ontario and Western Railroad Company, relative to complaint of Robert McAdam & Sons, of Rome. Ordered that hearing be set down for 2.15 P. M., September 15, 1890, and the parties notified.

Letter of Daniel T. Benton, complaining that the New York, Lake Erie and Western Railroad Company was not building fences on Buffalo Division of said road at Hornellsville. Ordered usual course.

Letter of J. M. Toucey, general manager New York Central and Hudson River Railroad Company, relative to condition of Albion station. Ordered copy sent to complainants.

Letter of Edward M. Burns, president Herkimer, Newport and Poland Narrow Gauge Railroad Company. Ordered copy sent Mr. Spencer with the request that he state whether he had inspected the road and, if so, had he especially and carefully examined the condition of the bridges and with what result.

Letter of H. Montfort, asking to be inofrmed of any application for change of motive power of the Jamaica and Brooklyn Railroad Company. Ordered filled.

Letter of J. A. McDonald, village clerk of Greenbush, asking this Board to inform the board of trustees of Greenbush, when the bridge over Partition street is to be built Ordered that a copy of the communication be sent to both the New York Central and Hudson River Railroad and the Boston and Albany Railroad Companies. Also ordered that a minute be made that a communication from the New York Central and Hudson River Railroad Company of date of October 5, 1889, announcing that the Boston and Albany and the New York Central and Hudson River Railroad Companies had agreed to begin the construction of the aforesaid bridge.

Answer of the Long Island Railroad Company to the special inquiry of the Board, relative to facilities at Hunter's Point. Ordered filed.

Letter of Sibley, Lindsey & Curr, alleging discriminations by United States, Wells, Fargo & Co., and American Express Company, against the city of Rochester in favor of Buffalo. Ordered usual course.

Letter of H. G. Young, general manager Delaware and Hudson Canal Company, in answer to complaint of William Abbott. Ordered that letter, as dictated, be sent. The Board heard Mr. P. J. Gleason, president of the Long Island City and Newtown Railroad Company, in the application of the company for a change of motive power. Also Messrs. Brown & Liebenstitt for the Metropolitan Crosstown Railway Company in an application for an increase of capital stock.

The Board heard Mr. E. Lauterback, in the matter of a proposed increase of capital stock of the Third Avenue Railroad Company.

The Secretary submitted the unfinished business, as follows:

Letters of American Express Company and Wells, Fargo & Co., being answers to complaint of Sibley, Lindsey & Curr as to discrimination against the city of Rochester in express rates. Ordered usual course.

Letters of W. Abbott and of Suburban Rapid Transit Company, relative to citation to company to show cause of their failure to comply with the recommendation of this Board in the matter of complaint of the residents of Westchester against said Suburban Rapid Transit Company. Referred to Commissioner Rogers.

Letter of John T. Bramhall (Albany Evening Journal), relative to reported utterance of Governor Seymour, as to status in 1862. Ordered that Secretary answer that the Board has no knowledge of any such utterance, and knows of no power vested in the Governor to take such action.
