On motion of Mr. McGill the Senate then stood in recess until 7:30 o'clock p. m.

Mr. President in the chair.

SIGNING OF HOUSE ENROLLED ACTS.

The chairman of the House Enrollment Committee was announced with certain enrolled acts for the signature of the president of the Senate.

Thereupon Mr. President gave notice that he was about

to sign:

E. A. No. 62, House "An act providing for the building of a nurses' dormitory, a dead house, stable, chicken house and other improvements and repairs at the Wyoming General Hospital at Rock Springs, Wyoming, and providing for the levy of a tax for funds therefor."

E. A. No. 63, House-"An act to amend and re-enact Section 3268 of the Revised Statutes of Wyoming, in relation to corporations."

E. A. No. 64, House "An act to amend and re-enact Section 4870 of the Revised Statutes of Wyoming, relative to the guardianship of minor children."

E. A. No. 65, House-"An act authorizing boards of county commissioners to refund the bonded indebtedness of the county which has matured, or may hereafter mature; providing the denominations of such refunding bonds, and how the same shall be sold or exchanged; and fixing a tax for the payment of the interest thereon, and the ultimate redemption thereof."

E. A. No. 66, House-"An act to amend and re-enact Section 5416 of the Revised Statutes of Woyming, relating to the time for filing motions for new trial in criminal cases."

E. A. No. 67, House-"An act to amend and re-enact Sections 4558 and 4559 of the Revised Statutes of Wyoming, 1999, relating to revocation of appointments of executors, adminis trators, etc."

E. A. No. 68, House-"An act to appropriate the balance remaining in the State Hospital Building Tax Fund, and the

future accumulations thereof towards the construction of permanent improvements at the Wyoming General Hospital at Rock Springs."

E. A. No. 69, House "An act to amend and re-enact Sections 3346 and 3350 of the Revised Statutes of Wyoming relative to the drawing of jurors."

E. A. No. 70, House-"An act providing for the rewriting, compilation, publication and distribution of a certain pamphlet heretofore edited by the secretary of state, and commonly known as The State of Wyoming,' having a special reference to the resources of the state and making an appropriation therefor."

E. A. No. 71, House-"An act exempting members of the Wyoming National Guard from road poll tax."

And thereupon Mr. President did, in the presence of the Senate, affix his official signature to the said House Enrolled Acts above enumerated.

CONCURRING IN HOUSE AMENDMENTS TO SENATE FILE NO. 39.

Mr. Black moved that the Senate do concur in the House amendments to said S. F. No. 39.

A vote being had on the motion, resulted as follows:

And thereupon Mr. President declared that the Senate had concurred in said House amendments to S. F. No. 39. REPORT OF CONFERENCE COMMITTEE ON S. F. NO. 32. The following report was received and read:

Senate Chamber.

Cheyenne, Feb. 16, 1901. Mr. President of the Senate and Mr. Speaker of the House: We, your Conference Committee appointed to agree upon the differences between the House and the Senate on S. F. No. 32, beg leave to report that we recommend that the House recede from its amendment to said bill, which was as follows: Strike out the words "in the Philippines" in line 5, Section 1.

Mr. Nichols moved that the report of the Committee be adopted and that said S. F. No. 32 be returned to the House with the request that that honorable body concur therein.

MESSAGE FROM THE GOVERNOR.

lature:

Gentlemen:-I have the honor to hereby nominate C. B. Holmes of Sheridan county as superintendent of water division No. 2, for a term of two years, vice Fred Bond, resigned, and A. O. Hamilton of Sweetwater county as superintendent of water division No. 4, for a term of two years, vice John Iredale, resigned, and ask your consent that appointments may issue as provided by law.

Mr. Davis moved that the Senate do now advise, consent to and confirm the nomination of C. B. Holmes as superintendent of water division No. 2 for the term of two years, vice Fred Bond, resigned, and O. A. Hamilton as superintendent of water division No. 4, for a term of two years, vice John Iredale, resigned.

A roll being called on the motion to confirm the said nomination, the same resulted as follows:

Ayes-Black, Brittain, Davis, Griffin, Guernsey, Hawk, Iredale, Madden, McBride, McGill, Nichols, Osmond, Rusk, Sullivan, Thomas, Verbryck, Williams, Mr. President-18. Noes, 0; absent, 0.

And thereupon Mr. President announced that the Senate had advised, consented to and confirmed the nomination of C. B. Holmes and O. A. Hamilton as superintendents of water divisions Nos. 2 and 4, respectively for a term of two years.

Mr. McGill moved that the Senate refuse to recede in the amendments made to said H. B. No. 151, and that the Senate ask the House to appoint a conference committee to act with a like committee from the honorable Senate to adjust the differences existing between the Senate and House on said H. B. No. 151.

The motion prevailed.

On motion of Mr. Nichols Mr. President appointed as the Senate conferees on H. B. No. 151 Messrs. McBride, McGill and Nichols.

VOTE OF THANKS TO OFFICERS AND EMPLOYES. Mr. Sullivan moved that the members of the Senate tender a vote of thanks to the officers and employes of the Senate of the Sixth State Legislature for faithful services performed. The motion prevailed by a rising vote of all the members present.

SIGNING OF HOUSE ENROLLED ACTS.

Mr. President gave notice that he was about to sign certain House Enrolled Acts and he did, in the presence of the Senate, affix his official signature to the following entitled House Enrolled Acts:

E. A. No. 72, House "An act relating to the appointment of police justices of cities of a population of not less than 10,000 inhabitants."

E. A. No. 73, House-“An act to prevent obstructions to the flow of water in irrigating ditches, declaring certain obstructions to be misdemeanors and fixing the penalty therefor."

E. A. No. 74-"An act to amend and re-enact Section 971 Revised Statutes, 1899, with reference to unlawful interference with water rights."

E. A. No. 75, House "An act to amend and re-enact Section 865, Revised Statutes, 1899, relating to the duties and powers of the state board of control.”

E. A. No. 76, House-"An act fixing the amount of the bond of the state examiner and providing for the payment of its premium when furnished by a surety company."

E. A. No. 77, House-"An act to regulate the driving or floating of logs, timber or lumber upon the streams of the state of Wyoming, so as to prevent obstructions to irrigating ditches."
