The Senate was called to order at 10 o'clock a. m., pursuant to adjournment of yesterday, Mr. President in the chair. Roll call:

Cheyenne, Jan. 31, 1901.

We, your committee who, in conjunction with a like committee from the House of Representatives, were appointed to proceed to the penitentiary building situated at the City of Rawlins, in Carbon County, for the purpose of investigating said building, and to estimate the probable expense of placing the same in proper condition for the reception of prisoners, beg leave to report that we visited the said penitentiary building and also the penitentiary building at Laramie, and after a thorough and full investigation, find that certain changes ought to be made in the penitentiary building at Rawlins, and also that a sewerage connection should be made with the city sewer, and that certain other buildings, such as bakery, laundry, bath house and work shops are necessary, and that the estimated cost of such changes and improvements amounts to fourteen thousand, five hundred dollars. We recommend that an appropriation in the way of a levy amounting to three-sixteenths of one mill be made for the years 1901 and 1902, for the purpose of raising funds with which to make such changes and additions. CONSIDERATION OF BILLS ON GENERAL FILE.

On motion of Mr. Nichols, the Senate resolved itself into a committee of the whole for the consideration of bills on the general file, Mr. Brittain being called to the chair.

Pending the report of the committee of the whole, the chairman of the House Enrolling Committee was announced with House Enrolled Act No. 5, "An Act for the exemption from taxation of certain property used for educational and charitable purposes," for the signature of the Hon. President of the Senate, and the President did, in the presence of the Senate, affix his official signature thereto.

COMMUNICATION FROM THE GOVERNOR.

The following communication was received and read:

I have the honor to inform you that I have this day approved and signed the following:

Senate Joint Resolution No. 1, concerning the death of Queen Victoria.

House Joint Resolution No. 3, authorizing the printing of 1,000 copies of the Governor's message.

House Joint Resolution No. 4, providing for a temporary committee of arrangements to visit and examine public institutions.

House Enrolled Act No. 2, to amend and re-enact Section 2989, Revised Statutes.

House Enrolled Act No. 3, to amend and re-enact Section 4254, Revised Statutes, relating to transcript filed and petition in error.

House Enrolled Act No. 4, to repeal Section 1771 of the Revised Statutes. Very respectfully. DeF. RICHARDS.

Upon arising, the committee of the whole presented the following report:

Your committee of the whole, having had under consideration bills on the general file, beg leave to report as follows:

We recommend that H. B. No. 6, by Mr. Butler-A bill for "An act to amend and re-enact Section 3419 of the Revised Statutes of Wyoming of 1899, prescribing the fees of the clerk of the district court in civil cases," do pass.

That S. F. No. 11, by Mr. Balch—A bill for "An act to amend and re-enact Section 1056 of the Revised Statutes of Wyoming, 1899, defining the terms of county commissioners and fixing the amount of their bond," do pass.

That H. B. No. 44, by Mr. Jarman—A bill for “An act to amend Section 2981 of the Revised Statutes of Wyoming, 1899, relating to void marriages," do not pass.

That H. B. No. 38, by Mr. Breckons—A bill for “An act to amend Section 4319 of the Revised Statutes of the State of Wyoming, relating to salaries of justices of the peace," do not pass.

That S. F. No. 27, by Mr. Griffin-A bill for "An act to amend and re-enact Section 2179 of the Revised Statutes of the State of Wyoming, 1899," be indefinitely postponed.

That Sub. for S. F. No. 25, by Committee No. 8-A bill for "An act to amend and re-enact Sections 2162 and 2163 of the Revised Statutes of 1899, providing for licenses for the sale of

spirituous, malt and fermented liquors and wines and for other purposes," be referred to Committee No. 21, on Printing, for the purpose of having same printed.

That H. B. No. 52, by Mr. Roberts-A bill for "An act to amend and re-enact Section 1139 of the Revised Statutes of Wyoming, relative to deputies in counties of the first and second class," do pass.

Mr. McGill moved that the report of the committee of the whole be adopted, with the exception of that portion thereof which referred to Senate File No. 27, by Mr. Griffin-A bill for "An act to amend and re-enact Section 2179 of the Revised Statutes of the State of Wyoming, 1899."

Mr. Sullivan moved to amend the motion of Mr. McGill that the report of the committee of the whole be adopted.

A division being demanded, the vote resulted as follows:
Voting to adopt the amendment of Mr. Sullivan-10.
Voting against the amendment-5.

Whereupon Mr. President declared that the amendment had been adopted, and carried therewith the principal question, to-wit: that the report of the committee of the whole be adopted.

On motion of Mr. McGill, the Senate then stood in recess until 2 o'clock p. m.

The Senate was called to order at 2 o'clock p. m., Mr. President in the chair.
