Mr. Buttars moved to reconsider the vote by which the Senate passed the bill; Which motion prevailed.

The question being on the passage of the bill,

By unanimous consent, Mr. Buttars moved to amend the bill by adding to section 1, line 3, after the word "Taylor" the words "both of Benzie county;" Which motion prevailed, and the bill was so amended.

House bill No. 200 (file No. 109), entitled

A bill to amend article 5, of act No. 198, session laws of 1873, entitled "An act to revise the laws providing for the incorporation of railroad companies, and to regulate the running and management, and to fix the duties and liabilities of all railroad and other corporations owning or operating any railroad in this State," approved May 1, 1873, by adding 2 new sections thereto,

Was read a third time, and pending the taking of the vote thereon,

By unanimous consent, Mr. Chandler moved to amend the bill by adding to section 1 the words "to read as follows;"

Which motion prevailed, and the bill was so amended.

The bill, as amended, was then passed, a majority of all the Senators elect voting therefor, by yeas and nays, as follows:

The Senate went into committee of the whole on the special order,

After some time spent therein, the committee rose, and through their chairman, made the following report:

The committee of the whole have had under consideration the following:

1. Proposed substitute for Senate bill No. 200 (file No. 209), entitled

A bill to provide for the sale of State tax lands;

2. Senate bill No. 200 (file No. 122), entitled

A bill to provide for the sale of State tax lands;

Have adopted the substitute for the original, made sundry amendments thereto, and have directed their chairman to report the same back to the Senate, asking concurrence therein, and recommend its passage.

Report accepted and committee discharged.

Mr. Caplis moved that the Senate concur in the action of the committee in adopting the substitute, and in the amendments made to the same.

Mr. Upson called for the yeas and nays.

Pending the taking of the vote,

Mr. Patterson moved to lay the motion on the table;

The action of the committee of the whole was then concurred in by yeas and nays as follows:

A bill to amend an act entitled "An act to re-incorporate the village of Kalamazoo, and to repeal all inconsistent acts and parts of acts," approved March 15, 1861, as amended by the several acts amendatory thereof, by adding thereto thirty-one new sections, to stand as sections 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66, 67, 68, and 69, and to repeal all acts and parts of acts inconsistent thereto,

Respectfully report that they have had the same under consideration, and have directed me to report the same back to the Senate without amendment, and recommend that it do pass, and ask to be discharged from the further consideration of the subject.
