AN ACT to amend the education law, in relation to state scholarships for honorably discharged soldiers, sailors and marines, and making an appropriation therefor.

Became a law May 13, 1919, with the approval of the Governor. Passed by a two-thirds vote.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Chapter twenty-one of the laws of nineteen hundred ch. 21 (re- and nine, entitled "An act relating to education, constituting chapter sixteen of the consolidated laws," as amended by chapter one hundred and forty of the laws of nineteen hundred and ten, is hereby amended by inserting therein, at the end of article thirteen,1 a new section, to be section seventy-eight and to read as follows:

§ 78. State scholarships for soldiers, sailors and marines. Four hundred and fifty state scholarships are hereby established for the benefit of resident soldiers, sailors and marines who shall have served as such in the army, navy or marine corps of the United States in the world war and been honorably discharged from such service, and who shall have or acquire the necessary qualifications as to secondary or other preparatory education to be required by the commissioner of education under rules and regulations to be established by him as hereinafter provided Each of such scholarships shall entitle the holder thereof to his tuition, in a sum not exceeding one hundred dollars per year, in any college, university, normal, technical or trade school of his selection, located within the state, such tuition to be paid by the state together with an additional sum of one hundred dollars per year for the maintenance of the holder of each of such scholarships while in attendance upon instruction under such scholarship. The commissioner of education shall award said scholarships and for that purpose shall establish rules and regulations for ascertaining the educational qualifications of persons

who may be entitled to the benefits of this section. The com-
missioner shall hold competitive examinations at least once a
year and shall select the students to be certified for scholarships
from each assembly district. The commissioner of education
shall give thirty days' notice to each member of assembly of the
date and place of the examination which is held in the district of
such assemblyman or in the county in which the assembly district
of such assemblyman is located. A list of the names and addresses
of the persons appointed to scholarships for each assembly dis-
trict shall be forwarded to the assemblyman of such district by the
commissioner of education within ten days after such appoint-
ments are made. Not more than three appointments shall be made
from any assembly district. In awarding the scholarships the
commissioner shall first select those who meet the requirements
for admission to college. If the full quota of scholarships is not
filled by appointments from this class, the remaining number of
scholarships shall be filled by appointment of persons who desire
to take preparatory courses. The tuition and maintenance of the
person holding the scholarship while pursuing the studies in such
preparatory courses shall be paid as hereinbefore provided.
Application for such scholarships shall be made on or before Sep-
tember first, nineteen hundred and twenty-three. Any such
scholarship may be revoked by the commissioner of education for
cause. The preceding sections of this article shall not apply to
scholarships provided for in this section, but such scholarships
shall be deemed to be in addition to the state scholarships pro-
vided for in this article. The authorities in control of an institu-
tion to which a person is admitted for instruction under this sec-
tion shall cause the certificate of appointment of such person as a
holder of such scholarship to be filed with the comptroller, and
moneys appropriated for carrying out the provisions of this sec-
tion shall be paid by the state comptroller upon the certificate of
the commissioner of education accompanied by vouchers signed by
the authorities in control of the institution to which the money is
to be paid.

AN ACT authorizing the superintendent of state prisons to
acquire for prison purposes certain lands and structures in the
town of Fort Ann, county of Washington, and making an
appropriation therefor.

The People of the State of New York, represented in Senate
and Assembly, do enact as follows:

Section 1. The superintendent of state prisons is hereby Purchase of authorized and directed to enter into negotiations with the per- authorized; sons in whom is vested the title to property hereinafter described, for the purchase of such property. If such purchase be concluded, such superintendent of state prisons may pay therefor a purchase price not exceeding fourteen thousand dollars. The land so acquired shall be deemed a part of the lands of Great Meadow prison and shall be under the control of the agent and warden of such prison. In negotiating with the interested parties for the acquisition of such property, the state superintendent may purchase or otherwise arrange for the release of all liens, leases, options or other incumbrances or matters affecting such premises, provided, however, that the expense thereof and of securing clear title to such property be limited to the sum of fourteen thousand dollars before mentioned. All that parcel or lot of land situate, lying and being at Comstocks in the town of Fort Ann, county of Washington and state of New York, bounded and described as follows: Beginning at a point eighteen feet from center of the Granville road, bearing south eleven degrees forty-five minutes east and forty-four feet three inches from the northwest corner of the stone wall on the opposite side of the road; thence north twenty-one degrees twenty minutes east a distance of two hundred twenty-nine feet six inches to a point in stone wall; thence along stone wall south eighty-two degrees twenty minutes east a distance of thirty-four feet six inches; thence south no degrees twenty-one minutes east a distance of one hundred sixty-six feet ten inches to a point (eighteen feet from the center of the highway, said point bears south fortyone degrees forty minutes east a distance of forty-eight feet eight

AN ACT to legalize acts and proceedings of the city of Olean, in relation to providing, by certificates of indebtedness, moneys for flood abatement work, including a special city election on September thirtieth, nineteen hundred and eighteen, to authorize the raising of moneys for such purpose, and to authorize the issuance and sale of city bonds to provide for the payment of such certificates.

All of the acts and proceedings of the city of Olean, by its electors, the common council, mayor, city clerk, boards, officers and agents, for borrowing twenty-five thousand dollars or any part thereof, applied or to be applied to the completion of the flood abatement work provided for by chapter seven hundred and seventeen of the laws of nineteen hundred and fifteen, being all such acts and proceedings before, during and after the special election held in such city on the thirtieth day of September, nineteen hundred and eighteen, including the notice of such election, the submission and adoption thereat of a proposition authorizing the amount aforesaid or a part thereof to be raised by tax for
