On or before the thirtieth day next preceding the date
upon which payment shall be made under a cooperative
highway contractual agreement between the commissioner
of transportation and the New York state thruway
authority, the commissioner of taxation and finance
shall certify to the director of the budget, the
commissioner of transportation and the chairman of the
New York state thruway authority the amount of such
payment to be made under a cooperative highway con-
tractual agreement. Upon receipt of such certification
from the commissioner of taxation and finance, the
director of the budget shall cause to be prepared a
certificate of approval of availability to enable the
payment from the emergency highway reconditioning and
preservation fund to the New York state thruway
authority; provided, however, that the maximum amount
to be paid shall not exceed the amount available in
such fund for such payment pursuant to the provisions
of section 89 of the state finance law.
Notwithstanding the provisions of any general or special
law to the contrary, no portion of this appropriation
shall be available for the purpose designated until a
certificate of approval of availability shall have
been issued by the director of the budget and a copy
of such certificate filed with the state comptroller
and the chairmen of the senate finance committee and
the assembly ways and means committee. Such certifi-
cate may be amended from time to time subject to the
approval of the director of the budget and a copy of
each such amendment shall be filed with the state
comptroller and the chairmen of the senate finance

§ 10. The sum specified in this section, or so much thereof as may be sufficient to accomplish in full the purposes designated by the appropriation, is hereby appropriated from the emergency highway construction and reconstruction fund, and is made available for the fiscal year beginning April 1, 1992.

$24,000,000, or so much thereof as may be available and necessary, is hereby appropriated for payment by the state comptroller to the New York state thruway authority for the purpose of meeting the terms of any cooperative highway contractual agreements between the commissioner of transportation and the New York state thruway authority.

development corporation, or any successor agency, under the terms of any lease, sublease or other financing agreement between such corporation, the department of mental hygiene and the New York state medical care facilities finance agency during fiscal year 1992-93. The state comptroller is hereby authorized to use any balance remaining in this appropriation, after making the payments required pursuant to any lease, sublease or other financing arrangement between the facilities development corporation, the department of mental hygiene and the New York state medical care facilities finance agency for the purpose of making payments to such agency of the amount of the earnings from the investment of moneys deposited in the mental health services fund that such agency determines will or may have to be rebated to the federal government pursuant to the provisions of the internal revenue code of 1986, as amended, in order to enable such agency to maintain the exemption from federal income taxation of the interest paid to the holders of such agency's mental health services facilities improvement revenue bonds. On or before June 30, 1993, such agency shall certify to the state comptroller its determination of the amounts received in the mental health services fund as a result of the investment of the moneys deposited therein that will or may have to be rebated to the federal government pursuant to the provisions of the internal revenue code of 1986, as amended. Notwithstanding the provisions of section 40 of the state finance law or any other provision of law to the contrary, this appropriation shall remain in full force and effect until July 31, 1993 .. The sum of $1,434,488,000, or so much thereof as may be necessary, is hereby appropriated for transfer by the state comptroller to the mental hygiene patient income account notwithstanding the provision of any other law during fiscal year 1992-93

emergency highway construction and reconstruction
fund, after making the January 1, 1993 payment to the
New York state thruway authority pursuant to a cooper-
ative highway contractual agreement, to the general
fund of the state of New York. Such transfer of any
balance remaining in the emergency highway construc-
tion and reconstruction fund shall be made on or
before March 31, 1993.
Notwithstanding the provisions of any general or special
law to the contrary, no portion of this appropriation
shall be available for the purpose of making payments
to the New York state thruway authority pursuant to a
cooperative highway contractual agreement until a
certificate of approval of availability shall have
been issued by the director of the budget and a copy
of such certificate filed with the state comptroller
and the chairmen of the senate finance committee and
the assembly ways and means committee. Such certifi-

The sum of $260,100,000, or so much thereof as may be necessary, is hereby appropriated for payment to the local government assistance corporation pursuant to a certificate or certificates filed by the chairman of the corporation with the state comptroller and the governor, pursuant to subdivision 1 of section 3240 of the public authorities law, in accordance with the following schedule

In the event that the amount set aside by the comptroller pursuant to paragraph (b) of subdivision 5 of section 92-r of the state finance law is not sufficient to fully pay debt service or required payments when due, the comptroller shall immediately transfer from the general fund to the local government assistance tax fund an amount which, when combined with the amount set aside pursuant to paragraph (b) of subdivision 5 of section 92-r of the state finance law, shall be sufficient to meet the payments required by the certificate or certificates.

§ 12. The sum specified in this section, or so much thereof as may be sufficient to accomplish in full the purposes designated by the appropriation, is hereby appropriated from the school financing reserve fund, and is made available for the fiscal year beginning April 1, 1992.

DEBT SERVICE FUND--SCHOOL FINANCING RESERVE FUND

The sum of $1,657,000, or so much thereof as may be necessary, is hereby appropriated for payment by state comptroller to the Dormitory Authority for the purpose of meeting the terms of any contractual agreements between the participating Special Act School Districts and the Dormitory Authority
