By chapter 50, section 1, of the laws of 1990: The sum of $22,000,000 is hereby appropriated to the state of New York mortgage agency, for deposit in the appropriate account or fund of the homeowner mortgage revenue bonds general resolution. Such appropriation shall only be made available, upon certification by the director of the budget, to the state of New York mortgage agency when and to the extent that the agency certifies to the director of the budget that monies available to the agency are not sufficient to meet the agency's obligations with respect to all bonds issued under the homeowner mortgage revenue bonds general resolution dated September 10, 1987 as amended. Copies of the certification made by the director of the budget shall be filed with the chairs of the senate finance committee and the assembly ways and means committee 22,000,000

The

appropriation made by chapter 261, section 14, of the laws of 1988, is amended and reappropriated to read: The sum of fifteen million dollars ($15,000,000), or so much thereof as may be necessary and available, is hereby appropriated from the state purposes account of the general fund to the state of New York mortgage agency, for deposit in the mortgage insurance fund established by section [two thousand four hundred twenty-nine-b] 2429-b of the public authorities law as the aggregate reserve amount of the mortgage insurance fund. Any moneys expended pursuant to the provisions of this appropriation shall forthwith be transferred to the general fund, to the extent moneys are available, from the housing reserve account of the New York state infrastructure trust fund tablished pursuant to section [eighty-eight] 88 of the state finance law. Such appropriation shall only be made available, upon certification by the director of the budget, to the state of New York mortgage agency to the extent and if the agency requires the use of the aggregate reserve amount of the mortgage insurance fund. For services and expenses of the occupational safety and health training and education program pursuant to chapter 886 of the laws of 1985. No more than 10 percent of total monies available pursuant to this appropriation shall be retained by the department of labor administration, including program monitoring, fiscal and program auditing, contract processing and program evaluation. The department of labor shall submit an annual program evaluation to the governor and the legislature by September 15 of each year. For services and expenses of the career opportunity professional recruitment education program to be operated by the offices of mental retardation and developmental disabilities and mental health, the governor's office of employee relations, and with the department education as necessary, to provide training in occupational and physical therapy for employees of state and voluntary operated agencies pursuant to a plan approved by the division of the budget. A portion of funds appropriated may be transferred to the state education department and the office of mental health for expenses directly related to the implementation of approved training programs, except that no funds may be transferred for administration .. 1,446,000 .
