ENERGY RESEARCH AND DEVELOPMENT AUTHORITY

For energy research and development activities according to the following:

Notwithstanding the provisions of subdivi-
sion 4-a of section 18-a of the public
service law: all moneys committed or ex-
pended from the appropriation shall be
reimbursed by assessment against gas cor-
porations and electric corporations as
defined in section 2 of the public service
law, and the total amount which may be
charged to any gas corporation and any
electric corporation shall not exceed 0.88
cents per one thousand cubic feet of gas
sold and 0.0088 cents per kilowatt-hour of
electricity sold by such corporations in
their intrastate utility operations in
calendar year 1990.
Such amounts shall be excluded from the gen-
eral assessment provisions of subdivision
2 of section 18-a of the public service
law, but shall be billed and paid in the
manner set forth in such subdivision and
upon receipt shall be paid to the state
comptroller for deposit in the state trea-
sury for credit to the miscellaneous spe-
cial revenue fund.

The director of the budget shall not issue a
certificate of approval with respect to
the commitment and expenditure of moneys
hereby appropriated until the chairman of

For payment, including an amount not to exceed 0.5 percent of nonpersonal service for prior year obligations and the acquisition, lease or lease purchase of replacement aircraft, according to the following schedule:

With the approval of the director

of the budget, the amounts appropriated herein may be made available to other state agencies or authorities for expenditures incurred in the operation of these programs. Notwithstanding any law to the contrary, revenues credited to any of the department's special revenue funds and accounts shall be available for deposit to the indirect charges account of the miscellaneous special fund.
