be considered to regularly share the com-
household of their parent or the
spouse of their parent. For the purposes
of sections 4308 and 4313 of the education
law, admission to the school for the blind
in the city of Batavia shall be for the
purposes of instruction and provision of
health and habilitative services in an in-
termediate care facility for the develop-
mentally disabled. The commissioner of
education, the commissioner of social ser-
vices, the commissioner of mental retarda-
tion and developmental disabilities, and

the director of the budget, in consulta-
tion with other appropriate state agencies
and departments, shall enter into an in-
teragency agreement to assure effective
implementation of these provisions. Not-
withstanding any other provision
of law,
the director of the budget is authorized
to transfer the monies hereby appropriated
to the department of social services for
payments for intermediate care services
for the developmentally disabled at rates
certified by the commissioner of mental
retardation and developmental disabilities
and approved by the director of the bud-
get, in accordance with the provisions of
this appropriation.

For services and expenses pursuant to chap-
ter 53 of the laws of 1990 related to the
operation of the school for the blind. The
comptroller is hereby authorized and di-
rected to deposit all income derived from
tuition charges paid by school districts,
residential maintenance charges paid by
social services districts and reimburse-
ments for the school lunch and breakfast
programs to the credit of the school for
the blind account in this miscellaneous
special revenue fund. Up to $605,900 of
the amount appropriated herein may be
transferred to the miscellaneous special
revenue fund
indirect cost recovery

account.

The comptroller is hereby authorized and directed to loan money to this account in

State Purposes Account

For transfer to the Batavia ICF/DD special revenue account for payments for intermediate care services at the school for the blind in the city of Batavia for the children eligible to participate in the intermediate care facility for the developmentally disabled (ICF/DD) component at the school. Funds shall not be expended unless a plan has been prepared by the department in accordance with rules and regulations of the commissioner of education and the director of the budget has determined that title XIX funds are receivable on account or otherwise available for payment

For services and expenses related to the operations of the Batavia intermediate care facility to be financed, in part, from a transfer from the general fund, as authorized by the general fund state purposes account for the Batavia ICF/DD program. The comptroller is hereby authorized and directed to deposit to this account amounts received in medicaid revenues, for reimbursement for the department's costs incurred after April 1, 1992. The comptroller is hereby authorized and directed to loan money to this account in accordance with the provisions set forth in section 1 of this act.

For services and expenses pursuant to chapter 53 of the laws of 1990 related to the operation of the school for the deaf. The comptroller is hereby authorized and directed to deposit all income derived from: tuition charges paid by school districts, residential maintenance charges paid by social services districts, preschool payments from municipalities and reimbursements for the school lunch and breakfast programs to the credit of the school for the deaf account in the miscellaneous special revenue fund. The comptroller is further authorized and directed to deposit to this account certain aid to localities funds, subject to the approval of the director of the budget, for the support of services to deaf infants pursuant to section 4204-a of the education law. Up to $544,600 of the amount appropriated herein may be transferred to the miscellaneous special revenue fund indirect cost recovery account.

The comptroller is hereby authorized and directed to loan money to this account in accordance with the provisions set forth in section 1 of this act.
