Notwithstanding the provisions of paragraph (f) of subdi

vision 1 of section 250, sections 258-b and 258-aa of the agriculture and markets law or any other section of law, the commissioner is authorized, with the approval of the director of the budget, to assess against any funds available to the dairy promotion order, the milk producers' security fund, and the agricultural producers' security fund, the actual costs incurred by the department in carrying out its responsibilities with

regard to each such order or fund. The

state council on agricultural development and innovation is hereby continued, consisting of nine members appointed by the

governor, two on the recommendation of the temporary president of the senate and two

the recommendation of the speaker of the assembly. The members of the council shall serve for terms of two years provided, however, that, of the members first appointed, four shall serve for terms of one year and five shall serve for terms of two years. Four of the five members first appointed serving two-year terms shall be those recommended by the temporary president of the senate and the speaker of the assembly. The council shall elect a chairman and a vice chairman from among its membership. In appointing the members of the council,

shall ensure that none of the members shall be officers or employees of any state department or agency and that each shall be,

be, by professional training or experience and attainment, qualified to analyze and interpret matters pertaining to agricultural development and innovation. The governor shall also attempt to include representatives from each major sector of the agriculture and food industry, including but not limited to, dairy, livestock, poultry, fruit, vegetable, horticulture/ floriculture, food processing, wholesale/retailing, and

specialty crops sectors. The purpose of the council shall be to work with and ad

vise the department in all aspects of the formulation, implementation and evaluation of the programs to further research new technologies and specialty industries for

York agricultural products; to enhance agricultural product quality and market development; and to provide economic development technical assistance for agricultural businesses. Further, the council shall work with and advise the department in identifying specific areas of research and development and recommending priorities within such areas; in identifying other-thanstate funds, including grants and fellowships, for the purpose of furthering agricultural research and development in New York; and in the coordination and distribution of all research and development funds.
