vouchers certified or approved by the commissioner of education.

The moneys hereby appropriated, or so much
thereof as may be necessary, are to be
available for the purposes herein speci-
fied for obligations heretofore accrued or
hereafter to accrue for the school years
beginning July 1, 1990, July 1, 1991 and
July 1, 1992

For the education of native Americans
For nonpublic school aid for the remaining
1991-92 school year program and initial
payments for 1992-93 school year program
For allowances to private blind and deaf
schools, including state aid for blind and
deaf pupils in certain institutions to be
paid for the purposes provided by article
85 of the education law for the education
of deaf children under 3 years of age.
Notwithstanding any other inconsistent
provisions of law, such aid shall be for
the New York state pupils approved to at-
tend such schools and whose admissions,
attendance and termination therein is in
accordance with rules and regulations of
the commissioner of education. The commis-
sioner shall determine by rules and regu-
lations, as approved by the director of
the budget, the definition of aidable
operating expenses and shall further re-
quire such information at such times as
the director deems necessary in order to
determine aidable operating expenses. In
making such determination for schools un-
der article 85 of the education law, the
commissioner shall be guided by expendi-
tures at the schools for the blind and
deaf at Batavia and Rome.

Notwithstanding any other provision of law,
the commissioner shall submit to the
chairman of the senate finance committee,
the chairman of the assembly ways and
means committee and the director of the
budget on or before November 1, 1992, an
annual report to include, but not be lim-
ited to, a description of the activities
undertaken
expenditures for the pri-
vate blind and deaf schools during the
1991-92 school year including: (i) the
number of children served by school, by
age group and by type of primary handicap-
ping condition, (ii) the number of staff

employed by each school, including staff-
ing ratios comparing instructional staff
and children served, (iii) separate de-
scriptions of the activities and expen-
ditures associated with the deaf infant
and BOCES program components,
and (iv)
projected enrollments, staffing patterns,
and expenditures by school, for the 1992-
93 school year

For the state's share of preschool handi-
capped education costs pursuant to section
4410 of the education law. Notwithstanding
any other provision of law, the state's
share of preschool handicapped education
costs shall not exceed 50 percent
Handicapped pupil court orders for the
state's share of court orders, pursuant to
section 4406 of the education law (for li-
abilities incurred prior to July 1, 1992).

For July and August programs for children
with handicapping conditions, pursuant to
a chapter of the laws of 1992, including
remaining 1991-92 and prior school years
obligations and up to 70 percent of 1992-
93 school year obligations. Notwithstand-
ing any other provision of law, the
state's share for July and August programs
for school-aged children with handicapping
conditions shall not exceed 70 percent of
approved costs. School districts of resi-
dence shall be responsible for 20 percent
of approved costs and counties of resi-
dence shall be responsible for 10 percent
of approved costs. Of the amount appropri-
ated to the state education department for
the July and August
August school-aged handi-
capped program, an amount to be determined
by the commissioner of education and ap-
proved by the director of the budget,
shall be transferred to the special reve-
nue funds other Batavia school for the
blind and Rome school for the deaf ac-
counts of the state education department
to provide funding for the cost of tu-
ition, maintenance and transportation for
the current year enrollment for July and
August of handicapped children ages 5
through 21 attending

by chapter 683 of the laws of 1986. Such
amount will be determined by the
tuition rate and the total number of chil-
dren approved by the commissioner for
placement for the current summer school
session during July and August. Notwith-
standing any other provision of law to the
contrary, such funds shall not be made
available until the commissioner submits
to the director of the budget, a report
which details each summer tuition rate for
the 1991-92 school year established by the
commissioner for summer public school
placements, specific expenditures, includ-
ing administration, direct care staff,
nondirect care staff and other than per-
sonal service which comprise the rate and
an explanation of the methodology used to
establish such rate ....
