AID TO LOCALITIES - MISCELLANEOUS FOR DEPOSIT IN THE EMERGENCY HIGHWAY CONSTRUCTION agreements between the commissioner of transportation No portion of this appropriation shall be available for 20,000,000 FOR DEPOSIT IN THE EMERGENCY HIGHWAY RECONDITIONING The sum of $20,000,000, or SO much thereof as may be AID TO LOCALITIES - MISCELLANEOUS FOR DEPOSIT IN THE EMERGENCY HIGHWAY RECONDITIONING transportation and the chairman of the New York state No portion of this appropriation shall be available for 20,000,000 GENERAL PURPOSE LOCAL GOVERNMENT AID General Fund Local Assistance Account For payment to counties, cities, towns and villages for the support of local government. Notwithstanding any other provision of law, each city, town and village shall receive 84.6 percent of the amount of aid it received in state fiscal year 1991-92. Each county shall not be eligible to receive aid pursuant to section 54 of the state finance law, as amended by chapter 141 of the laws of 1987, chapters 53 and 566 of the laws of 1988, chapter 53 of the laws of 1989, chapter 53 of the laws of 1990, as amended by chapter 947 of the laws of 1990, and chapter 53 of the laws of 1991, as amended by chapters 407, 408 and 409 of the laws of 1991. Provided, however, that any city with a population of 1,000,000 or more shall receive the same amount of aid as it received as a county and as a city in state fiscal year 1989-90, and that the city of Lackawanna shall receive 99 percent of the amount of aid it received in state fiscal year 1989-90, pursuant to section 54 of the state finance law. For the purposes of calculating the amount of aid to be distributed to cities, the amount of aid received by cities in state fiscal year 1991-92 shall exclude any reductions in aid made pursuant to the pension savings offset account as established by chapter 53 of the laws of 1991. Notwithstanding any other provision of law, on September 15, 1992 each city shall receive the sum of the amount of aid it received on September 15, 1991, and the amount of aid withheld in state fiscal year 1991-92 pursuant to the pension savings offset account as established by chapter 53 of the laws of 1991. On June 25, 1992, each city shall receive the difference between what it would receive in state fiscal year 1992-93 as specified in this section and the amount of aid to be paid on September 15, 1992. Notwithstanding any other provision of law, on April 25, 1992 the city of Hudson shall receive the same amount of aid it was entitled to receive on April 25, 1991. On May 25, 1992 and May 31, 1992, respectively, the cities of Olean and Lackawanna shall receive the same amount of aid they were entitled to receive on May 25, 1991 and May 31, 1991, respectively. On June 25, 1992, the cities of Hudson, Lackawanna and Olean shall receive the difference between what they would receive in state fiscal year 1992-93 as specified in this section and the sum of the amount of aid to be paid on September 15, 1992 and the aid payments made prior to June 25, 1992 for the state fiscal year 1992-93. Payment of such aid to cities having a population of 1,000,000 or more shall be made in the same manner and schedule by the office of the state comptroller as prescribed by section 54 of the state finance law, as amended by chapter 141 of the laws of 1987, chapters 53 and 566 of the laws of 1988, chapter 53 of the laws of 1989, chapter 53 of the laws of 1990, as amended by chapter 947 of the laws of 1990, and chapter 53 53 of the laws of 1991, as amended by chapters 407, 408 and 409 of the laws of 1991. Notwithstanding any other provision of law, all aid payable to towns and villages from this appropriation shall be paid on September 15, 1992. Further provided, however, notwithstanding any other provision of law, for any cities, towns or villages which consolidate, merge or dissolve in state fiscal year 1992-93, the resulting successor government shall file with the office of the state comptroller a certificate of any such consolidation, merger or dissolution and shall thereby receive any remaining payments of aid which would otherwise have been payable in the 1992-93 state fiscal year to the individual local governments who were parties to such consolidation, merger or dissolution. In instances where only a portion of a city, town or village is party to a consolidation, merger or dissolution, aid payable to the resulting successor government shall include only a pro rata share of the aid otherwise due and payable in the 1992-93 state fiscal year to such city, town or village. Such pro rata share shall be based on a ratio of 1990 decennial population of the portion consolidated, merged or dissolved as compared to the total 1990 decennial population of the city, town or village party to such consolidation, merger or dissolution. It is the intent of the legislature that reductions otherwise taken as the city of New York's proportionate share of reductions in general purpose local government aid for state fiscal years 1989-90 through 1992-93 shall be deducted from aid payable to such city for reimbursement of approved senior college programs and services at the city university of New York for the city fiscal year beginning July 1, 1992; and thereafter, such reductions shall be taken in general purpose local government aid after such aid is first made available for claims pursuant to sections 54 and 92-e of the state finance law, as amended by a chapter of the laws of 1992. Notwithstanding any other provision of law, the amounts paid from this appropriation to any city, county, town or village for the support of local government shall constitute the complete liquidation of the state's obligation for such purposes pursuant to section 54 of the state finance law 734,072,211 General Fund For prepayment of general purpose local government aid to cities with a population of 1,000,000 or more for the support of local government. Such appropriation shall be available for payment up to and including March 31, 1993 and shall be for aid otherwise payable in state fiscal year 1993-94.
